Terms of Service
1. Scope
These Terms of Service govern the use of the menuQR platform (hereinafter "the Platform") and its associated services. The Platform is operated by [PLACEHOLDER: Full name / company name] (hereinafter "the Provider").
By registering on the Platform or using the services, you agree to these Terms of Service. If you do not agree with these terms, you may not use the Platform.
2. Services Provided by the Provider
The Provider offers a web-based platform that enables restaurant operators to upload PDF menus, generate QR codes, and publish a digital menu page. The services include:
- Upload of PDF menus with automatic thumbnail generation
- Generation of static QR codes
- Public menu pages under a unique URL
- Analytics dashboard for evaluating views and scans
The availability of individual features depends on the chosen subscription plan (Starter, Professional, or Enterprise). Pricing details can be found on the website.
3. Registration and Account
Registration is required to use the Platform. During registration, you must provide truthful information. The email address must be verified before the trial period is activated.
You are responsible for keeping your login credentials confidential and are liable for all activities conducted under your account. You agree to notify the Provider immediately if there is reason to suspect unauthorized use.
Only one account per user is permitted. Registration with disposable email addresses is not allowed and will be blocked.
4. Trial Period and Subscription
New users receive a free 7-day trial period after successful email verification. During the trial period, all features of the chosen subscription plan are available.
After the trial period expires, access to uploads, analytics, and public menu pages is restricted unless a paid subscription is purchased. Existing QR codes remain valid, but linked menu pages are deactivated.
Subscriptions (Professional and Enterprise) are billed monthly via the payment service provider Stripe. No credit card is required for the trial period. The subscription can be cancelled monthly at any time.
5. User Obligations
You agree to use the Platform exclusively for lawful purposes. In particular, it is prohibited to:
- Upload menus or content that infringes the rights of third parties (copyright, trademark, privacy rights)
- Use the Platform for illegal, misleading, or fraudulent purposes
- Take technical measures to circumvent access restrictions or usage limits
- Overload the Platform with automated scripts or bots
- Upload security-relevant code or malicious files
You are solely responsible for the accuracy and legality of uploaded menus and content.
6. QR Codes and Menu Pages
Generated QR codes may be freely used, printed, and distributed by you. The QR code links to a public menu page on the menuqr.codes domain.
The Provider reserves the right to deactivate menu pages if there is suspicion of a legal violation or if the subscription is inactive. You will be notified by email upon deactivation.
The linked PDF file can be changed at any time by re-uploading. The QR code and URL remain unchanged.
7. Payment Terms
Paid subscriptions are billed monthly in advance via the payment service provider Stripe. Prices are exclusive of applicable VAT.
Refunds for monthly subscriptions are only possible after explicit consultation with the Provider. In case of payment defaults, access to the services may be temporarily suspended.
8. Termination
The subscription can be cancelled monthly. Cancellation is done by unsubscribing in the account dashboard or by email to support@menuqr.codes.
After cancellation, access to uploads and analytics ends at the end of the paid billing period. Public menu pages are deactivated. Generated QR codes may continue to be used but link to a deactivated page.
The Provider reserves the right to suspend accounts immediately in case of serious violations of these Terms of Service.
9. Liability
The Provider is liable without limitation for intent and gross negligence. For slight negligence, the Provider is only liable in case of breach of an essential contractual obligation and only to the amount of typically foreseeable damages.
The Provider does not guarantee uninterrupted availability of the Platform. Maintenance work and temporary disruptions may occur.
The Provider is not liable for content uploaded by users. You indemnify the Provider from all claims by third parties arising from content you uploaded.
10. Privacy
The processing of personal data is governed by the applicable Privacy Policy, which is part of these Terms of Service.
11. Changes to These Terms of Service
The Provider reserves the right to adjust these Terms of Service as needed. Users will be informed of significant changes by email. The new version then applies to continued use.
